Indoor Bouldering Recreational Activity Risk Warning, Acknowledgement, Waiver and Release Form

Participation in indoor bouldering and associated gym activities (Recreational Activities) supplied by Gripswich PTY LTD (Service Provider) involves significant risks, including the risk of personal injury and death. Particular risks include, but are not limited to: falls from height onto padded surfaces; awkward or uncontrolled landings; collisions with other participants; physical exertion leading to heart attack, panic or hyperventilation in susceptible individuals; and negligence on the part of the Participant or others around the Participant.

1. Before you participate in the Recreational Activities, you should ensure that you are aware of, and properly understand, all of the risks involved in the Recreational Activities, and that those risks include any particular risks associated with any health condition or pre-existing disability from which you suffer.

2. The Service Provider's policies for your participation in the Recreational Activities are as follows:

2.1 Please conduct yourself with courtesy, respect and kindness. When the Service Provider's staff set out particular requirements for the Recreational Activities, you must comply with those requirements to ensure that both you and other participants can enjoy the Recreational Activities as safely as possible.

2.2 Please inform the Service Provider of any injuries or concerns prior to commencing the Recreational Activities. If at any point before or during participation the Service Provider's staff consider that you are unfit or pose a risk to yourself or others, they reserve the right to refuse participation.

2.3 In order to protect your health and safety, you must follow all instructions provided by the Service Provider's staff before and during participation.

2.4 The Service Provider recommends that you consult with a physician before participating. If you experience any pain or discomfort during participation, stop immediately and seek medical attention.

2.5 If you are pregnant, you must inform the Service Provider prior to participation.

2.6 You understand that it is your responsibility to judge your physical condition and capabilities. You must not exceed your limits while participating. You acknowledge that you will select activities appropriate to your skill level and any physical or mental conditions. You understand that staff may suggest techniques or equipment use, but it is your sole responsibility to determine whether this is appropriate. You warrant that you are in good health and in proper physical and mental condition to participate. If at any time you believe conditions to be unsafe, you will immediately cease participation.

3. By signing this document, you acknowledge, agree and understand that you participate voluntarily and at your own risk, with full knowledge of the risks described above.

4. If signing as a parent, guardian or responsible person, you acknowledge that you have explained the risks of the Recreational Activities to the Participant.

5. By signing this document, you acknowledge that this risk warning constitutes a formal "risk warning" under the Civil Liability Act 2003 (Qld).

6. You recognise that there are risks involved in the Recreational Activities. You accept financial responsibility for any injury you may cause to yourself or others due to your negligence. You agree to indemnify and hold harmless the Service Provider, its principals, agents, employees and volunteers from liability for any injury, death, or property damage resulting from your negligent or intentional acts. You also agree to reimburse any legal costs incurred to enforce this document.

7. Section 139A of the Competition and Consumer Act 2010 (Cth) permits the Service Provider to exclude certain statutory guarantees.

8. By signing this document, to the full extent permitted by law:

8.1 Your rights to sue the Service Provider for failure to exercise reasonable care and skill are excluded, restricted or modified.

8.2 You release the Service Provider from liability for failure to comply with such guarantees.

9. To the full extent permitted by law, the Service Provider excludes liability for:

9.1 death;
9.2 physical or mental injury;
9.3 contraction or aggravation of disease;
9.4 any harmful condition or circumstance,

arising from participation in the Recreational Activities.

10. You agree to waive and release the Service Provider from any claims arising from injury, death, loss, damage or economic loss suffered during or as a result of participation, whether caused by negligence or otherwise.

11. You acknowledge that:

11.1 Participation is permitted in consideration of signing this document;
11.2 The Service Provider may rely on this document in legal proceedings;
11.3 This agreement is governed by the laws of Queensland.

12. This waiver applies to all future visits unless withdrawn or replaced by a new agreement.

13. You consent to being photographed or recorded during activities and for this content to be used for promotional purposes without compensation.

14. You confirm that you have read and understood this document, accept the risks, and understand that you are waiving legal rights by signing it.

Gripswich Terms & Conditions v1

Membership and Facility Use Agreement

These Terms & Conditions ("Agreement") apply to all members and visitors of Gripswich PTY LTD ("Service Provider"). By accessing or using the facility, you agree to be bound by this Agreement.

1. General Use of Facility

1.1 The facility is for indoor bouldering and associated gym activities only.
1.2 All participants must comply with staff directions at all times.
1.3 The Service Provider reserves the right to refuse entry or remove anyone whose behaviour is unsafe, disruptive, or non-compliant.

2. Membership and Entry

2.1 All participants must complete and sign a valid waiver prior to entry.
2.2 Memberships and passes are non-transferable unless otherwise stated.
2.3 Proof of identity may be required for entry.
2.4 The Service Provider reserves the right to suspend or cancel memberships at its discretion.

3. Safety and Conduct

3.1 Participants must act responsibly and with consideration for others.
3.2 Climbing while under the influence of drugs or alcohol is strictly prohibited.
3.3 Participants must not engage in unsafe practices, including:
3.3.1 climbing directly above or below another person;
3.3.2 entering fall zones while others are climbing;
3.3.3 ignoring posted rules or staff instructions.
3.4 Appropriate clothing and footwear must be worn at all times.
3.5 Chalk use must comply with gym policies.

4. Supervision of Minors

4.1 Participants under 18 must have a waiver signed by a parent or guardian.
4.2 Children must be supervised as required by the Service Provider's policies.
4.3 Supervising adults are responsible for the behaviour and safety of minors in their care.

5. Bookings and Classes

5.1 Bookings may be required for certain sessions, classes, or events.
5.2 Cancellation policies may apply and will be communicated at the time of booking.
5.3 The Service Provider reserves the right to modify or cancel sessions.

6. Fees and Payments

6.1 All fees must be paid prior to participation unless otherwise agreed.
6.2 Membership fees are billed as agreed at the time of purchase.
6.3 Fees are non-refundable except where required by law.
6.4 The Service Provider reserves the right to change pricing with reasonable notice.

7. Personal Property

7.1 Participants are responsible for their personal belongings.
7.2 The Service Provider is not liable for loss, theft, or damage to personal property.

8. Equipment Use

8.1 Any equipment provided must be used as instructed.
8.2 Participants must not misuse or damage equipment.
8.3 Any damaged or faulty equipment must be reported immediately.

9. Health and Fitness

9.1 Participants are responsible for ensuring they are physically and medically fit to participate.
9.2 Participation is at the individual's own risk and subject to the signed waiver.

10. Photography and Media

10.1 The Service Provider may photograph or record activities within the facility.
10.2 By entering the facility, you consent to the use of such media for promotional purposes unless you notify staff otherwise.

11. Suspension and Termination

11.1 The Service Provider may suspend or terminate access for breaches of these Terms & Conditions.
11.2 No refunds will be provided for suspensions due to misconduct.

12. Changes to Terms

12.1 The Service Provider reserves the right to update these Terms & Conditions at any time.
12.2 Continued use of the facility constitutes acceptance of any updated Terms.

13. Governing Law

13.1 These Terms & Conditions are governed by the laws of Queensland, Australia.

14. Acknowledgement

By accessing or using the facility, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

Why we collect this. We use these details to identify you at check-in, to contact you or your emergency contact if something happens, and to record which version of the waiver you agree to. Gender is collected to track and encourage gender-diversity in climbing; your postcode helps us understand where our climbers come from; and the “keep me up to date” tick is optional and off unless you turn it on. For any under-18 you add, your yes/no on using their photos is honoured per child. Health information you give us is sensitive information, used only for your safety and never for marketing.
